1. Acceptance of Terms

Welcome to Exacta3D an FBN under Inked Vest LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website and services, including the custom plotting and printing of designs onto safety vests (collectively, the “Services”).

PLEASE READ CAREFULLY: By creating an account, placing an order, or clicking “I Agree,” you agree to be bound by these Terms. If you do not agree, you may not access or use the Services. These Terms constitute a binding legal agreement between you and Exacta3D.   

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Services (such as a pop-up or banner) or by email to the address associated with your account. Your continued use of the Services after such notice constitutes your acceptance of the new Terms. Passive posting of updates to this page without notice will not be deemed sufficient notice for material changes.   

To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to terminate accounts that violate these Terms or engage in prohibited conduct.   

• Nature of Goods: You acknowledge that the products sold by Exacta3D are according to your preference. Once an order enters the production phase, it cannot be cancelled or modified.

• Right to Refuse Service: We reserve the right to cancel any order for any reason, including pricing errors or inability to fulfill the request. If we cancel your order, we will refund any payments already made.

5. Payment and Pricing

• Payment Terms: Payment is due immediately upon placement of the order. We accept major credit cards and other payment methods as displayed at checkout.

• Taxes: Prices generally do not include sales tax. Applicable taxes will be calculated and added at checkout based on your shipping address.

• Pricing Errors: Despite our best efforts, pricing errors may occur. We reserve the right to cancel any orders placed for products listed at an incorrect price.   

6. Shipping and Risk of Loss

• Risk of Loss: All items purchased from Exacta3D are made pursuant to a shipment contract. This means the risk of loss and title for such items pass to you upon our delivery to the carrier (FOB Shipping Point). You are responsible for filing any claims with carriers for damaged or lost shipments.

• Shipping Estimates: Shipping dates are estimates only and are not guaranteed. We are not liable for delays caused by carriers or events beyond our reasonable control.

7. 15-Day Money-Back Guarantee

We want you to be completely satisfied with your modular Pool Cue Lathe kit. If our product does not meet your expectations, we offer a straightforward 15-day return policy.

Guarantee Terms and Conditions

• The 15-Day Window: You have 15 days from the date your order is officially delivered to initiate a return for a refund.

• Item Condition: To be eligible for a full refund of the purchase price, the product must be returned in its original, resalable condition. It must show no signs of abuse, modifications, or accidental damage.

• Included Components: All original 3D-printed parts, hardware, tools, and original packaging must be included in the return shipment. Incomplete returns may be subject to a restocking fee or rejection of the refund.

• Shipping Costs: Original shipping charges are non-refundable. The customer is responsible for safely packaging the item and covering all return shipping costs.

How to Process a Return

• Request Authorization: Contact our customer support team at [Insert Contact Email/Phone] with your order number and a brief reason for the return. We will provide you with a Return Merchandise Authorization (RMA) number and the return shipping address.

• Ship the Item: Securely pack the kit to prevent transit damage. You must clearly write the provided RMA number on the outside of the shipping box. We strongly recommend using a trackable shipping service or purchasing shipping insurance, as we cannot issue refunds for items lost in transit.

• Inspection and Refund: Once your return is received and inspected by our team, we will send you an email to notify you of the approval or rejection of your refund.

• Processing Time: Approved returns will be refunded to your original method of payment within 5 to 7 business days. Please note that it may take additional time for your bank or credit card company to post the funds to your account.

8. One-Year Limited Warranty

• What This Warranty Covers Exacta3D (“Company,” “we,” “us,” or “our”) warrants to the original purchaser that our products, including the modular Pool Cue Lathe and all associated 3D-printed components, will be free from material defects in materials and workmanship under normal, intended use.

• How Long the Coverage Lasts This limited warranty lasts for a period of one (1) year from the date of original retail purchase or the date of delivery, whichever is later (the “Warranty Period”).

• What This Warranty Does Not Cover This warranty is strictly limited to manufacturing defects. Because our products include specialized 3D-printed components and hardware, this warranty does not cover damage or failure resulting from:

• Normal Wear and Tear: Natural degradation of materials over time, including cosmetic damage such as scratches, dents, or fading.

• Improper Use or Assembly: Damage caused by failing to follow provided instructions, improper assembly, or using the product for anything other than standard pool cue maintenance and repair.

• Environmental Damage: Warping, melting, or deformation caused by leaving 3D-printed components in direct sunlight, extreme heat, or harsh environmental conditions.

• Modifications: Any unauthorized alterations, modifications, or repairs made to the product by the user or a third party.

• Accidental Damage: Drops, impacts, or damage caused by the use of incompatible aftermarket parts or tools.

• What Exacta3D Will Do If a valid claim is received within the 1-Year Warranty Period, Exacta3D will, at its sole discretion:

  • Repair the defective product or component at no charge.

  • Replace the defective product or component with a new or refurbished part of equal value and functionality.

• How to Obtain Warranty Service To initiate a warranty claim, you must contact our customer support team at support@exacta3d.com before the Warranty Period expires. You will be required to provide:

  • Valid proof of purchase (e.g., order number, receipt).

  • A clear description of the issue.

  • Photographs or videos demonstrating the defect.

  • If we determine that the item needs to be returned for inspection or replacement, we will provide you with a Return Merchandise Authorization (RMA) number and shipping instructions. The customer is responsible for initial return shipping costs, which may be refunded if the defect is confirmed to be covered under this warranty.

9. Limitation of Liability

To the maximum extent permitted by law, Exacta3D shall not be liable for any incidental, indirect, special, or consequential damages resulting from the use, or inability to use, this product. Our maximum liability under this warranty is strictly limited to the original purchase price of the product.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” Exacta3D DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Indemnification

You agree to defend, indemnify, and hold harmless Exacta3D, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your Customer Content; or (c) your violation of these Terms or any third-party right, including intellectual property rights.  

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

• Mandatory Arbitration: Any dispute or claim arising out of or relating to these Terms or your use of the Services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

• Class Action Waiver: You and Exacta3D agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

• Governing Law and Venue: These Terms shall be governed by the laws of the State of California. If Arbitration is found not to apply, you agree to submit to the personal jurisdiction of the state and federal courts located in Fontana, California.
